1. Who we are and what these terms cover

WHAT'S NEXT DIGITAL LTD (company no. NI688335, registered office 20c Balliniska Road, Springtown Industrial Estate, Derry, United Kingdom, BT48 0NA) trades as What's Next Digital. These terms cover your use of this website and any services we agree to provide. The written quote or proposal you receive for a specific piece of work sits alongside these terms; if the two disagree, the quote wins for that engagement.

2. The services

We offer four ways of working, described on the pricing page: the Roadmap (a working session and a written, prioritised plan), the Build Sprint (agreed items from a roadmap, built), the Partner plan (a monthly arrangement keeping what we built running and improving), and one-off jobs quoted flat. Each stands on its own: none requires you to buy another, and whatever a service produces is yours to keep. The listed prices are starting points; the exact scope and price for your engagement are agreed in writing before any paid work starts. The first 30-minute call is free and carries no obligation on either side.

3. Quotes, payment and cancellation

Work begins when you accept a written quote or proposal. Invoicing amounts and timing are as set out in that quote. For Build Sprint work, the built items are demonstrated working before final payment is due. The Partner plan runs monthly from an agreed start date with a three-month minimum; after the minimum, either of us can end it with written notice as set out in the proposal. If you cancel agreed work partway, you pay for the work completed up to that point.

4. What you own, what we keep

On full payment, the deliverables of your engagement are yours: plans, websites, automations, content and configurations built for you. We keep ownership of the tools, templates, starter code and know-how we bring to every engagement and use across clients; where any of that is included in your deliverable, you have a permanent licence to use it as part of what we built for you. The content on this website itself, including text, images and logos, is owned by WHAT'S NEXT DIGITAL LTD or used with permission.

5. Third-party services

The systems we build usually run on third-party services (for example hosting, databases, payment processing, booking, email and AI providers), normally on accounts in your name so you own your data and can leave with everything. Those providers have their own terms and fees, which are yours; we set the services up and configure them but do not control them, and we are not responsible for their availability, pricing changes or failures.

6. Your part

Good outcomes need your input: accurate information about your business, timely feedback, and any content, credentials and permissions the work needs. You are responsible for the legality of material you supply and for keeping your own account credentials safe. Where automations act on your behalf, you remain responsible for the business decisions they carry out.

7. Using this website

You may use this website for lawful purposes only. You agree not to misuse it, attempt to disrupt it, or use it in any way that breaks applicable law or infringes the rights of others.

8. Liability

Nothing in these terms limits liability that cannot be limited under applicable law, including for death, personal injury or fraud. Subject to that, we are not liable for indirect or consequential loss, and our total liability for any engagement is capped at the fees you paid for that engagement. Plans and systems we deliver are professional work, not a guarantee of specific business results, which depend on your business and how the work is used.

9. Privacy

How we collect, use, and protect your personal data is explained in our privacy policy.

10. Governing law

These terms are governed by the laws of Northern Ireland, and any disputes are subject to the jurisdiction of its courts.

11. Changes to these terms

We may update these terms from time to time. Changes are posted on this page with an updated date and apply to engagements agreed after that date. Continued use of the website after changes are posted is acceptance of the updated terms.
